The Local Government (Administration) Regulations 1996 regulation 29 C requires a local government to include on its website –

  • The name of each Council Member who lodged a primary return or annual return for a financial year beginning on or after 1 July 2020; and
  • The position of each employee who lodged a primary or annual return for a financial year beginning on or after 1 July 2020.

Under section 5.46 of the Local Government Act 1995 (WA) the Shire is required to keep a register of all delegations.

Elected Member Training

In accordance with section 5.127 of the Local Government Act 1995 (WA) the Shire will publish a report detailing the training completed by Councillors for the financial year. The report will be published after the end of the financial year to which the report relates.

Complaints Register

If someone lodges a complaint against a Council Member or Committee Member alleging, they have breached a provision of Division 4 of the Code of Conduct for Council Members, Committee Members and Candidates, that compliant is required to be submitted to the Local Government Standards Pane. The Panel then determines whether the alleged breach occurred or not.

If the Panel finds that a breach did occur, the Shire of Irwin is required to inset details of the complaint and breach into a Complaints Register.

Gift Register

Council Members and the Chief Executive Officer (CEO) must declare any gift received in their capacity as a council member or CEO valued at $300 or above (or the cumulative value of gifts from one donor exceeds $300 in a 12-month period), in accordance with sections 5.87A and 5.8B of the Local Government Act 1995 (WA).

If a Council Member receives any gift valued at $300 or above and the donor has a matter before council, the council member must disclose an interest and remove themselves from the meeting (unless approval is granted by council or the minister). The donor becomes a closely associated person with section 5.62 of the Local Government Act 1995 (WA).

Similarly, gifts received by the CEO will exclude them from involvement in a matter requiring a local government decision (unless approval is granted by Council or the Minister).

Under the Local Government Act 1995 (WA) and Local Government (Elections) Regulations 1997, there is a requirement to disclose gifts made to benefit of candidates. The CEO is to maintain a register of these disclosures.

Freedom of Information

The Freedom of Information Act 1992 gives individuals the right to apply for access to documents held by State Public Sector Agencies which includes Government Departments, Local Authorities, Statutory Authorities and Ministers.

Before lodging a Freedom of Information (FOI) request, please contact the Shire’s FOI Coordinator and ask about the specific information you wish to access. It may be the case that a FOI request is not necessary.

When a FOI request is necessary, it should be lodged in writing with enough details to enable the requested documents to be identified. An address in Australia and a contact number and email address should be provided.
